Land improvement associations

The land improvement system must be maintained and constructed as a single entity. Therefore, it is worth considering establishing a land improvement association with your neighbor(s). Existing land improvement systems are usually located on several properties, which in turn belong to different landowners, making it difficult to organize maintenance and improvement work in a targeted manner. It is practical to establish a land improvement association to plan and carry out this work.

What is a land improvement association?

  • A land improvement association is a private legal entity established for the joint organization of land improvement works, whose members are the owners of one or more integrated land improvement systems.
  • The establishment of a land improvement association is voluntary, but once established, all landowners on whose land the system is located must belong to the association. Landowners cannot leave the association.
  • It is also important to note that, due to the operating principle of the system, a cooperative cannot be formed for only part of the entire system, although a cooperative may cover several land improvement systems.
  • The land improvement cooperative has the right to request a map of the land improvement cooperative's area of activity and a certificate containing information on owners, cadastral units, the length of the headrace, the area of the regulating network, and the proportion of the maintenance obligation from the Land and Spatial Development Board.

Registration of a land improvement association

Land improvement association data is entered into the e-business register, which is maintained and registered by the Tartu County Court Registry Department. The state fee for entry into the register is €20. The state fee for changing and supplementing the data entered is €7.
