The process of constructing or reconstructing a land improvement system
A land improvement system may only be constructed or reconstructed on the basis of a building permit.
Construction may affect the functioning of the entire land improvement system, including the part that is not located on the land of the landowner planning the construction.
The construction or reconstruction of a land improvement system is similar to other construction carried out under the Building Code. Both the design conditions and the building and use permit for the construction of a land improvement system are issued by the Land and Spatial Development board (MaRu).
The landowner submits an application for design conditions to Land and Spatial Development board. One person can submit the application via the customer portal. If there are several owners of the land improvement system, the authorization of all owners is required, or an application digitally signed by all owners must be added.
Land and Spatial Development board provides the necessary source data for design in the design conditions, including a list of research works, a list of design conditions and special conditions, as well as the need for expert assessment and project coordination.
The design conditions procedure takes up to 30 days.
The design conditions are valid for three years.
The designer studies the situation on the ground and compiles a research report, which is submitted to Land and Spatial Development board. The project is compiled on the basis of the research data.
Conducting research and reporting
Research is necessary primarily to determine the condition of the land improvement system and the causes of excess moisture. The research provides the source data for the design. The research report is presented in the form of an explanatory note and drawings. The explanatory note explains in detail where, how, and what was researched, and what the situation was. The drawings show the areas with excess moisture, the locations of the research, and other necessary data.
The company that conducted the research submits the results of the research to both the applicant for the design conditions and Land and Spatial Development board within 30 working days of the completion of the research.
Project preparation
The project is prepared on the basis of the research data. The project solution must be prepared in such a way that, after construction in accordance with the project, the land is drained to a condition suitable for cultivation. If the data obtained from the research shows that it is not possible to ensure a drainage condition suitable for cultivation, the construction project will not be prepared.
The construction project must comply with:
- the design conditions for the land improvement system;
- the results of the land improvement research, if the research was provided for in the design conditions;
- the design standards for the land improvement system and the content and form requirements for the construction project.
A building permit is valid for seven years if construction has commenced within two years of obtaining the building permit, i.e., a notice of commencement of construction has been submitted within two years.
The landowner must submit an application to Land and Spatial Development board in order to obtain a building permit for the project.
The state fee for applying for a building permit is €20 for each land improvement system.

Explanation: Review of application for a land improvement system construction permit
The construction permit application and all accompanying documents must be in order, including the research and project. All required approvals must also be attached. In this case, the building permit procedure takes up to 30 days. If a preliminary environmental impact assessment is required before the building permit is issued, the building permit procedure is extended by another 90 days.
Construction of a small land improvement system
A small system is a land improvement system (MPS) located on one immovable property or on several immovable properties belonging to one landowner, with a total area not exceeding 50 hectares. A small system can be constructed on the basis of a construction plan, i.e. no project needs to be prepared for construction.
- The landowner orders a construction plan from a person entered in the register of companies operating in the field of land improvement (MATER).
- The landowner submits an application for a small system construction permit to Land and Spatial Development board together with the construction plan.
- The landowner submits a notice of commencement of construction to Land and Spatial Development board no later than three days before the start of construction.
- After completion of the construction, the landowner submits an application for a small system operating permit to Land and Spatial Development board, together with the as-built drawings and other necessary information.
Once the building permit has been obtained, construction can begin. The landowner must notify Land and Spatial Development board of the start of construction no later than three working days before the start of work and at least two years after obtaining the building permit.
If no environmental restrictions have been imposed after the building permit has been issued, work may commence on the date specified in the notification.
The landowner must submit an application for a use permit to Land and Spatial Development board within 90 days of the completion of construction work.
If the completed land improvement system meets the requirements, Land and Spatial Development board will issue a use permit within 30 days. In exceptional cases, if it is not possible to check compliance due to weather conditions (e.g., snow cover), the issuance of the operating permit will be postponed until on-site inspection is possible.
The application for an operating permit must be accompanied by the construction documents for the land improvement system:
- construction work log;
- certificate of completed work;
- documents certifying the compliance of construction materials and products;
- implementation drawing and land improvement system marking data;
- other documents describing the construction.
Construction is documented in accordance with the regulation "More detailed requirements for the documentation of construction and construction documents, and requirements for the storage and transfer of construction documents".
